Question: My wife and i just found out that when our house was built in 1972 the electrician or contractor that built this house, instead of using a third wire on 3-way switches they used the bear ground wire for their 3rd wire

After 38 years I really doubt that any type of home warranty is still in effect.
One alternative would be to remove this illegal practice and install x-10 switch modules.
You may pass this incident by your home insurance company and the local building officials.
